Jerry Royse Letter to the Governor regarding propsed changes in fees - Tuesday, October 25, 2011

Industry Update - Saturday, November 20, 2010

 Insights from Our Last Broker Class: 

Sharon Walsh and Nancy Harris, staff from the Alaska Real Estate Commission audited the broker prelicensing class last week and shed some light on several issues. They are both good to work with, and are committed to working closely with licensees and brokers to protect consumers in their real estate actions.

One discussion related to the AREC Consumer Pamphlet and the difficulties encountered when consumers don't want to sign the form.  Several options were discussed.  It is important to discuss the form and review its implications with the consumer and best to get their signature as the law requires.  If they refuse, options include making a note of their refusal on the form and if possible, get them to initial it.  This should hopefully be the exception to the rule and if it where, would be acceptable according to Sharon.  Other students have written on the form "I should not have to or I refuse to sign this form" and had the clients sign or initial the statement. 

 

In another discussion regarding Waiver of Right to be Represented one of our students from Juneau found it helpful by characterizing her position to her clients in stating "she becomes like Switzerland in the transaction." Other important points that can help include an accurate discussion of just what rights are actually being waived, and options available regarding the degree of confidential information the licensee is being given authority to disclose or act on.

 

AREC Left the E and O issue Tabled at September Meeting in Anchorage -- Read unofficial AREC meeting notes on our Forums

Waiting for new regulations from the department, the AREC left the E and O issue off the discussion until the new regulations are reviewed.  So nothing required at this point until the regulations are finalized.

40 cases were opened by the investigative officer based on late license renewal.  The criteria to open an investigation was based on a review of any listings or advertising that may have been done while licensee was in a lapsed status. 

Recent hearings and AREC decisions have severely limited the ability of real estate licensees to work for any other real estate company other than their own broker even if the activity is exempted as a real estate activity not requiring a license under the statutes.  More on that issue in the forums located on our community section.
