Waiting for new regulations from the department, the AREC left the E and O issue off the discussion until the new regulations are reviewed. So nothing required at this point until the regulations are finalized.
40 cases were opened by the investigative officer based on late license renewal. The criteria to open an investigation was based on a review of any listings or advertising that may have been done while licensee was in a lapsed status.
Recent hearings and AREC decisions have severely limited the ability of real estate licensees to work for any other real estate company other than their own broker even if the activity is exempted as a real estate activity not requiring a license under the statutes. One case is currently under reconsideration so more on that issue in the next newsletter.
